Any person who engages with a person engaged in prostitution who is under 18 years of age, or is a severely or profoundly intellectually disabled in any touching or fondling of the sex organs of one person by the other person, with the intent to achieve sexual arousal or gratification, or enters or remains in a place of prostitution for the purpose of engaging in, any contact, however slight, between the sex organ or anus of one person and an object or the sex organ, mouth, or anus of another person, or any intrusion, however slight, of any part of the body of one person or of any animal or object into the sex organ or anus of another person, including, but not limited to, cunnilingus, fellatio, or anal penetration(evidence of emission of semen is not required to prove sexual penetration) with a person, not his or her spouse commits the offense of Patronizing a Prostitute.
Patronizing a prostitute is a Class 3 Felony punishable by 2 to 5 years in the State Penitentiary and a fine up to $25,000.
If committed within 1,000 feet of real property comprising a school, or if the person is convicted of a second or subsequent violation, or has a prior conviction for Prostitution, Solicitation of a Sexual Act, Promoting Prostitution), Promoting Juvenile Prostitution, Soliciting for a Prostitute, Soliciting for a Juvenile Prostitute, Pandering, Keeping a Place of Prostitution, Keeping a place of Juvenile Prostitution, Patronizing a Juvenile Prostitute, Pimping, Juvenile Pimping or Aggravated Juvenile Pimping, or Exploitation of a Child then they are guilty of a Class 2 Felony punishable by 3 to 7 years in the State penitentiary and a fine up to $25,000.
